These Terms & Conditions govern access to and use of the RepCord website, early-access program, and any RepCord application or service that links to these Terms.
1. Acceptance of these Terms
By accessing or using RepCord, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the service.
References to “RepCord,” “we,” “us,” or “our” refer to the RepCord product project operated through Pescao' Creative Studio for the purposes described in these Terms.
2. Launch-stage and beta product
RepCord is in active development. Early-access, beta, prototype, preview, or test features may be incomplete, change without notice, contain errors, or be discontinued. Interface examples, metrics, workflows, and features shown on the website may evolve before or after public launch.
Joining an early-access list does not guarantee access, a particular launch date, a specific feature, continued availability, or a particular pricing model.
3. Eligibility
You must be legally permitted to use RepCord in your jurisdiction. RepCord is not directed to children under 13, and a higher minimum age may apply where required by local law. Minors may need authorization from a parent, guardian, gym, or other responsible adult.
4. Accounts and account security
If RepCord requires an account, you agree to provide accurate information, keep your credentials confidential, and notify us if you believe your account has been compromised. You are responsible for activity occurring through your account unless applicable law provides otherwise.
5. What RepCord provides
RepCord is designed to help athletes, coaches, and training organizations capture, organize, review, and understand training information. Features may include workout import, manual logging, exercise history, personal records, body metrics, performance analytics, coach-athlete connections, training programming, and AI-assisted analysis.
RepCord does not guarantee that a workout, movement, score, personal record, estimate, trend, recommendation, or imported item will always be detected or interpreted correctly.
6. Training, health and safety
Exercise carries inherent risk. You are responsible for choosing appropriate training loads, movements, intensity, environment, equipment, and supervision. Stop training and seek appropriate professional advice if you experience pain, injury, unusual symptoms, or any condition that may make exercise unsafe.
RepCord metrics, AI insights, estimated one-repetition maximums, progress indicators, recovery context, body metrics, or suggested targets are informational and may be inaccurate. They are not medical diagnoses, prescriptions, injury-clearance decisions, or guarantees of future performance.
7. User content and training data
You retain ownership of content and training information that you submit to RepCord, subject to rights held by third parties. You grant RepCord a limited, worldwide, non-exclusive license to host, process, reproduce, transform, and display that content only as reasonably necessary to operate, secure, improve, and provide the service and features you request.
You are responsible for ensuring that you have the right to upload or import content, including screenshots, files, programming, photos, or text created by someone else.
8. Coach, athlete and organization features
If you connect with a coach, athlete, gym, box, studio, or other organization, certain information may become visible or editable according to the relationship and permissions provided by the product. You are responsible for reviewing what you share and for using shared information appropriately.
A coach or organization using RepCord remains independently responsible for its professional decisions, programming, athlete relationships, safety practices, and legal obligations.
9. AI-assisted features
RepCord may use artificial intelligence or automated systems to parse workouts, identify movements, summarize data, detect potential personal records, or generate insights. These outputs may contain errors, omissions, or incorrect assumptions. You should verify important information before relying on it.
You may not use RepCord AI outputs as the sole basis for medical, safety-critical, or high-risk decisions.
10. Third-party services and imported data
RepCord may allow you to import, share, or connect information from third-party services. Third-party products are governed by their own terms and policies. RepCord is not responsible for the availability, accuracy, security, or conduct of third-party services.
References to third-party brands on the RepCord website do not imply sponsorship, endorsement, or a formal integration unless explicitly stated.
11. Acceptable use
You agree not to:
- use RepCord for unlawful, fraudulent, abusive, or deceptive activity;
- attempt to gain unauthorized access to accounts, systems, APIs, databases, or infrastructure;
- interfere with the service, bypass security measures, introduce malicious code, or overload infrastructure;
- scrape or systematically extract data except as expressly permitted;
- impersonate another person or misrepresent a coaching, gym, or athlete relationship;
- upload content that infringes intellectual-property, privacy, or other rights; or
- use the service to harass, exploit, or endanger another person.
12. RepCord intellectual property
RepCord, its branding, interface, original software, graphics, product design, written content, and related materials are protected by intellectual-property laws. Except for rights expressly granted in these Terms, no rights in RepCord intellectual property are transferred to you.
13. Feedback
If you provide product ideas, suggestions, bug reports, or other feedback, you grant RepCord permission to use that feedback without restriction or compensation, provided we do not publicly attribute private feedback to you without permission.
14. Paid features and subscriptions
RepCord may introduce paid plans, subscriptions, coach tools, gym tools, or other purchases in the future. Before charging you, RepCord will present the applicable price, billing period, renewal terms, taxes, cancellation information, and any additional purchase terms required by law.
15. Suspension and termination
You may stop using RepCord at any time. We may restrict, suspend, or terminate access if reasonably necessary to protect the service or users, respond to legal requirements, address non-payment, or enforce these Terms. Where appropriate and legally required, we will provide notice or an opportunity to remedy the issue.
16. Service availability and changes
We may modify, add, remove, or discontinue features. We do not guarantee uninterrupted or error-free availability. Maintenance, outages, third-party failures, security events, or product-development changes may temporarily affect the service.
17. Disclaimers
To the maximum extent permitted by applicable law, RepCord is provided on an “as is” and “as available” basis. We disclaim warranties that are not expressly required by law, including implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability.
18. Limitation of liability
To the maximum extent permitted by applicable law, RepCord and the people involved in operating it will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, lost data, training outcomes, injuries, or performance results arising from or related to use of the service.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
19. Indemnity
To the extent permitted by law, you agree to be responsible for losses or claims resulting from your unlawful use of RepCord, your violation of these Terms, or content you submit that infringes another person’s rights. This section does not apply where prohibited by mandatory consumer law.
20. Governing law and disputes
These Terms are governed by the law applicable to the jurisdiction in which the RepCord operator is established, without overriding any mandatory consumer-protection rights that apply to you. Before starting formal proceedings, we encourage you to contact us so we can try to resolve the issue directly.
21. Changes to these Terms
We may update these Terms as the product evolves. The revised Terms will show a new “Last updated” date. If a change materially affects your rights and applicable law requires notice, we will provide appropriate notice.
